I'm looking for free mulatto Capps in this area.
Anne West, a sister of the late Reubin Capps, asks that her brother's two slaves and other property be sold and the proceeds be divided among "his next of kin and heirs at Law." West reports that she has two brothers "of the whole blood" and one sister "who is of the half blood." Confessing that her husband "hath lately been sent from this County to the Penitentiary there to remain for a term of years yet to come," the petitioner laments that she "is thereby left without the means of support for herself and her family." She points out that "if She could now obtain her portion of her said deceased brother's estate, She in some measure would be relieved from "wretchedness and poverty." Noting that "there can be no specific division of the above mentioned Negros," West prays that her brother's administrator "be directed to sell them at public auction for ready money, and divide the proceeds of such sale together with such other money or personal property which he as administrator may have in his hands into seven equal parts," whereupon she and her brothers would each receive two-sevenths and her half sister would receive a one-seventh share.
Defendants listed are Amy, Andrew and Benjamin Capps and a Richard Eaton.
Later on an Eliza Capps registered in Princess Anne county as a free colored person. Could this be the "half blood" sister? If anyone has any ideas where to look to find some other record of her or any children she may have had I'd really appreciate the help. Thanks.
