Very well put AC, my first impression of his post was the same as yours, you countered well, and and to claim the 1866 treaty was the only act, is misleading, the Cherokee freed their slaves 3 years prior to the treaty of 1866, see the law by the Cherokee National Council here at this link: htttp://www.cornsilks.com/1863emplaw.gif

Then the Cherokee people took the 1863 Cherokee emancipation act and the 1866 treaty which was an agreemnet between the Cherokee and the federal Government, This was NOT an order forcing the slaves on the Cherokee as some would have the world believe. and made it in to actual Cherokee law. you can see the ammended 1839 Constitution at the following link: htttp://www.cornsilks.com/1839constitutionofthecherokeeo.html
