Withers vs Withers, VA, Court Records, 1789 The following taken from Fauquier County Minute Book, VA, 1788-1791, page 154. Court 29th May 1789. John WITHERS, Junior, Plt. against Jemima WITHERS, now HARRIS, Widow of James WITHERS, deceased, and George Washington WITHERS, Son and Devisee of James, an Infant under the age of twenty one years by said Jemima his Guardian James WITHERS, William WITHERS, William JENNINGS and Betty his Wife, Samuel DUNCAN and Nancy his Wife. John PICKETT and Hannah his Wife, and William HARRIS, Deft. This day came as well Plt. by his Counsel as Deft. George Washington WITHERS by his Guardian, and the other Defts. by their Counsel and the Cause was heard on the Bill, Answer and Depositions. On consideration whereof it is decreed and ordered George Washington WITHERS convey to Plt. in fee simple as soon as he shall attain the age of twenty one years or within six months there-after unless he shall shew cause to the contrary by good and sufficient Deeds in Law the land in the Bill and Deposition of John MAURY mentioned and that Jemima HARRIS be barr'd of her Dower therein and that Complainant recover against Deft. his Costs.
