Will of Nicholas Smith, Bourbon County, Kentucky

Last Will and Testament of Nicholas Smith, 8 February 1826.

In the name of God, Amen.  I, Nicholas Smith of Bourbon County State of Kentucky, being sick of body but of sound mind and disposing memory for which I thank God and calling to mind the uncertainty of human life and bring closure (by) disposing all such ______ estate as it _______ pleased God to so ______ me with I give and bequeth same in the following manner, that is to say.

... First I give unto my son Jacob Smith two negro boys, one named TOM about sixteen or nineteen years of age.  The other named JIM about the same age.
    Also, one thousand acres of land out of _____  _____ I purchased from Jacob Swope, beginning Sm_____'s line _____ running down Stoner including a spring known by McMillan's Spring for ________ which land is now in dispute.  Should the said land be lost he is not entitled to any part of my other lands, also the stock of horses, cattle, sheep, and hogs.  I have heretofore given him and his heirs forever the above mentioned boy TOM.  He has had in possession and sale to John Shawhan for which I have given a bill of sale the other he now has in his possession.

... Secondly, I give unto my son Nicholas Smith and his heirs forever all the remainder of my Estate both _______ and ________ of every description.

... Thirdly, I _______ I now give my three children Peter Smith, Joseph Smith and Elizabeth Smeltzer wife of Jacob Smeltzer wife of Jacob Smeltzer fully equal to the Share I intend for them.  I therefore devise and direct _____  _____ Shawhan  no more of my estate.  I may have at my death.
 
Lastly, I do hereby constitute and appoint my son Nicholas Smith executor of this my last will and testament hereby ______ing all other or _______ by me heretofore made in writing whereof.  I now ______ set my hand and seal this 8th day of Feb. 1826.  Acknowledged and signed in presence of ofics Wm Hutchinson Jr.  John Shawan.
