McILWAIN-AL-1829 Will of Andrew McIlwain, Sr. Washington County, AL -- 1829 In the name of God Amen -- I, Andrew McIlwain, Sr. -- Do make and declare on this my last will and testement in manner and form following; First I resign my Soul into the hands of Almighty God hoping and believing in a Redemption of Sins by the ministry and meditation of Jesus Christ; And my Body I commit to the Earth to be Buried at the discretion of my Executor here in after to be named: And my worldly estate I give and divide as follows. ... First I give and divide to my beloved wife during her life the improvement I now live on, also all my farming utinsiles and stock of cattle, hogs and horses together with all my household and Kitchen Furniture and all sums of money which is now owing to me or which may here after become due to me. ... I further give to my wife my two negroes name CHARLES and SUNNY. ... Secondly: I give to my son William one dollar to be paid out of any monies collected out of my Estate after my death - ... I also give to my son James one dollar to be paid out of any monies collected out of my estate. ... After my death I give to my daughter, Elizabeth Jordan, One dollar to be paid in monies and for as above: ... I give and divide unto my daughter Jane Lampkins: One negro woman named MARY with all her increase: ... Also I give and divice unto my sons Andrew and Thomas Equal shares of my negro man CHARLES after the death of my wife. ... Also I give and divice unto my suns David and Robert my negro man SUNNY after the death of my wife. Then my whole estate of Household and kitchen furniture, my stock of hogs and cattle and all and any thing that may appertain to the estate maybe Equally divided between my four sons, Viz: Andrew, Thomas, David, Robert, and to their heir forever. ... It is further my desire that if my sons Andrew and Thomas should die with out Lawful heirs of their Bodies that in that case that an equal division of what I give them may take place and that James, David, and Robert and their heirs to be intitled to Receive and inherit the same. ... Andrew McIlwain - - - - - - - - - - - - - - - - - - - - - - Andrew McIlwain was born in either Ireland or South Carolina. in about 1753. He was married to a woman named Elizabeth (thought to be Margaret "Elizabeth" Douglas) in about 1777. He left South Carolina in the fall of 1810. They traveled accross Georgia and into the old Mississippi Territory through Cherokee and Creek Indian Lands. This part of the old Mississippi Territory is an area is now known as northwest Washington County, Alabama.
