The treaty should be in force for all the FCT and not just for one. The other four should follow in acknowledging the treaty and granting citizenship for all. Is there another 1866 Treaty that is worded differently that would exclude the other four?
Norma, I believe that the issue is the scope of the ruling. Since the defendants mentioned were only the Cherokee, the other four remaining tribes were not included in the lawsuit. So for the other tribes to have similar rulings, similar lawsuits would have to be filed against them.
IANAL, so I'm hoping someone with better insights can clarify that.
