According to this (DC Gov.) you will not be allowed to order a death certificate until 50 years have passed since the death (which then it becomes public) and birth certificates 100 years, unless you are an immediate family member. Since it's only been 40 years the only way around it is to have an immediate family member request the record: Living spouse, adult child, legal rep., ect.
